When someone wants to keep your dog?Little Bitty Update;)(huskymom)

It wouldn't be the first time, on this forum, that people actually suggested heisting a dog that was in a bad situation or not getting proper medical care (not saying this is happening in this instance, but sometimes, we don't even know when our friends are not all they seem.)

I'm sorry, I really tried not to take offence to this statement, but I'm finding it hard.  I know you didn't really mean this situation, but can you honestly tell me that if you were to spend significant amount of time with someone, along with their dogs, see the behaviour and condition of the dogs and that person's demeanor regarding her dogs, that you would not know if something was so wrong a vet would want to remove the dog from that home?  I know I'm no where near as qualified as you are when it comes to dog behavior, but I'd like to think I would have noticed something.

I understand what she's trying to say, someone might find a dog and think- hey the owner is such a terrble person to let this dog get loose, I must keep him...   It's entirely wrong I think.

I hope that she is able to find Zia and bring her home!

Yes, but she spoke of the vet's motive, not the person that actually has Zia.

As long as she has PROOF of ownership - leagally - the vet cannot withhold that information. I would assume she has pictures and vet records - right?

Get that paperwork yesterday - and demand the dog back. Go to the papers, radio and news stations. That is outrageous that the vet would not give her her dog back. I, too, would have been removed in handcuffs...

Pics, Vet Records, and CKC Papers, yes.  Though currently the CKC papers still state the breeders as having ownership.  She's getting that changed right now.

Is there a Veterinary Board of some sort in Canada that Jen could file a formal complaint with against this Vet?  I would certainly do so in her situation.  It doesn't matter if he believes the dog is better off or what his motives are, it's completely unethical.

    and illegal.

it's like someone stealing your car. someone tells you they know where your car is - but wont tell you where. dogs are 'property' and this is stealing. withholding information is not acceptable.

even if the CKC papers are in her breeders name - the breeder would still have record of sale (as they are required to keep that information) and could vouch that she sold the dog to your friend.

I'd find a new vet, personally.

Actually, since the dog was not stolen, or at least there is not proof of intent to steal, the case becomes a civil matter, meaning no charges can be laid.  And Clayton can not be made to relay the information.  Sigh...  However, as soon as the dog is found, she'll be identified as Jen's dog and the case becomes a no brainer.  She'll go home with Jen.  The trick is just to find her first.

There are a few people looking for her.  But if I had trouble with Glenda's crew, I wonder how well some non dog people are gonna do from a distance, looking for a GSD that is likely hidden.  There's word out, and Jen put an ad on our radio station today, trying to be as nice as she could...

So fingers crossed folks?  iDog Vibes please.  They work miracles, we all know that.

right - but there has to be something against knowing where 'missing' property is, and not saying anything...

can she file a 'stolen property' report with the police? then he'd have to say where she is.

If Clayton cannot give out their name and contact (which I understand), why can the owner give him hers and simply ask that he contact them and pass along her info, let them know the dog does in fact belong to someone else?

    • Gold Top Dog

I believe one of his secretaries is doing that very thing Lies.  For Jen, not for Clayton.

Candace, any update on Zia?  Still good thoughts for a good outcome...

I haven't heard anything since Thursday, so I assume nothing.  I'll give her a call later and see.  Thanks for thinking of her.

Criminal conversion -From Wikipedia,  Criminal conversion, in criminal law, is usually defined as the crime of exerting unauthorized use or control of someone else's property. It differs from theft in that it does not include the element of intending to deprive the owner of the possession of that property. As such, it is a lesser included offense of the crime of theft. An example might be tapping someone's secured wireless LAN or public utility line (which could also amount to theft of services). Another example might be taking a "joy ride" in a car, never intending to keep it from the owner. Some places have defined such conduct as a specific type of theft, perhaps with a modified penalty. Note that the "unauthorized" use may begin after a period of authorized use, where, for example, a person rents a car then keeps it for an extra week without permission from the rental company. Another common example occurs when a person fails to report finding lost goods (including animals), intending only to keep them until someone asks for their return. When the intent becomes one of keeping them, it's a theft. [edit]

Your vet appears to be involved in a crime.  I talked with a man who had a similar problem. His two labs (rural-no collars or IDs) went for a walk. A distant neighbor decided to rescue the dogs and managed to capture one with a dart gun (she has an exotic santuary). She darted the mail after several attempts.  The female left and went home.  After several weeks, she took the dog to her vet.  He recognized the dog and called to owner, making sure he got his property back.

Your vet seems to prefer the dark side. Hopefully, you have another vet available.   If you do and do change providers, be sure he knows why.

I've been following this story and am also wondering if there are any updates.
