UPDATED!! PLEASE READ I wish there was something I could do about this...

    I don't have much time right now to post but I will respond to the question about if he has bitten anyone. He has bitten the maintence guy once, and he has almost killed one the neighbors schnauzers (sp?). The dog had to be hospitalized for weeks, and had to have several surgeries.

    I agree completely. The thing is, even though she knows that he is aggressive and has attacked other dogs before, she continues to walk him off leash. [:@]

    I have been thinking about this. I believe I know what she was calling herself doing. She has to know that it was me who complained to the management. I know that they spoke to her. So, instead of doing the responsible thing, and just putting her dog on a leash, she instead takes him out really early in the morning and late at night. I haven't seen him out at all during the day. Well, anyway, she saw that it was me last night, and she was trying to show that she was trying to "gain control" of the dog. One of the things that came out of her mouth while she was hitting him was "You're not gonna get to that dog, because I'm not gonna let you!!" She is just trying to do something (albeit one of the worst ways to go about it), because she knows the next step by the management is that they are going to have her remove the dog. I don't want that to happen, because the shelters around here are full as it is and with the dog being dog aggressive and possibly human aggressive, he WILL be euthanized immediately. I have seen more tame dogs then him go into those shelters and be determined too aggressive to be adoptable.

    [sm=smack.gif] I don't know why I never thought of calling a rescue around here. I feel ashamed of myself. [&o] Max came from a rescue who removed dogs from situations like these. I can't believe I didn't think of this a month or two ago, before this escalated into somethign like this.

    I don't believe that he is outright human aggressive. I know that he bit the maintenance guy when he came in to her apartment while she was there and he was changing an air filter. I can easily forgive that. He was intruding in his "territory". But it shows that the possibility is there for hbuman aggression. And I'm afraid that with him taking beatings like this will only cause him to become aggressive towards humans.

    As to what I carry with me on my walks, not much. I have some pepper spray that I sometimes carry with me, but I rarely do. Unless you count a pistol. I live near a bad part of town, so I have it to defend myself if need be. I would never use it on a dog though, unless I was being attacked and I had no other choice.

    I am going to send a rescue an email right now. Thanks for all the help. If anyone else has any ideas, please keep em coming.

    ETA: I wanted to clarify the bite issue with the maintenance guy. I don't believe that he bit him hard at all. Probably more of a warning then anything else. No damage was done that I know of.

    Well, I just sent the SARR place an email explaining the situation. I also asked if they knew of any more local rescues that I could get into contact with if need be. I hope this does the trick... [&o]

    I would of commited my own crime right there if I had seen what you did! How dare she do that to that poor dog, aggressive or not! I'd definately follow the advice of those telling you to report her to the police. That dog needs to be removed. If he does need to be put down at least he won't be suffering at her hands anymore.

    I guess I missed your post. But yes, it is hard. I know what you're going through as well, and let me tell you this. I have no feelings whatsoever for this woman. I honestly could really care less about what happens with her. I usually do not have much patience with people. Call me cold-hearted, but I'm more concerned about the dog. She isn't even worthy of being called a human in my book. I think there is a special circle of hell reserved for women beaters, child abusers and molesters, and animal abusers.

    I was stuck between a rock and a hard place. I will absolutely never hit or hurt a woman. Plus she had a dog that is aggressive toward other dogs. He is also an unneutered male dog. Max does not do well with unneutered male dogs. So if I had gone over there, I would have had a fight on my hands. So I did what I had to do to ensure the well being of my dog and myself. And that was getting out of that situation as fast as possible.

    Well, I haven't heard from the rescue today. I'm hoping that they will get in touch with me early next week. I hate that this dog is going to have to put up with this woman that long even... [&o]

    The spray won't hurt the dog, but they really don't like it.  Do you have an umbrella that pops up quickly?  That would help.

    I just got an email back from the Rottie rescue. They say that there is really not anything that they can do about this due to legality issues.
    [:(] What do I do now, if the rescue can't do anything? Especially since it has been so long since I witnessed it.

    You have record of your experience right here in this thread that, if left unedited, could've been used by authorities as your recollection of events.  Although I just looked and saw it's been edited.  Shoot.
     
    If you are afraid this dog will die if removed from her "care", and she evidently doesn't know/understand/accept?? an alternate way to address her dog's issues  then you are putting the responsibility for the decision onto someone else.  Do you really want to be the guy who, two weeks from now when the dog either mauls another dog, or gets hurt being loose in the road, who says, "Yeah, I saw her beating him just last week, but I didn't report it." 
     
    In your Hobson's Choice, I'd ask the Rottie rescue to refer you the name of an excellent trainer in your area.  Get in touch w/that trainer to find out if he's taking clients.  Get his business card and present it to her in whatever fashion.  Depends on how involved you want to get.  Failing that (either by her outright rejection of it, or your choice not to do that), I'd say you're obligated to report a crime, if this incident falls under a crime definition for your state/local laws.  My very humble opinion, as I realize you feel torn.  I hope the description above is helpful.

    Thank you for your response. I'm just a little at a loss. I was really hoping that the rescue would be able to do something. I emailed a different rescue last night, one that is much more local and actually specializes in stray, abandoned, and abused dogs. I'm not sure if they will do anything though, because they say that they do not take owner surrenders. But I think that just means that they do not accept people just coming and wanting to drop their dog off.

    But, I didn't put off calling the authorities on purpose. I thought I was trying to do the best thing for the dog. [&o] I don't know so much now..

    As far as the trainer, I can guarantee that she will not take the advice. She won't even spend time with the dog, much less train it.

    What would I have to stand on if I did report it? I realize I need to try regardless, but what are my chances?

    When you report this event to AC or the local authorities, they have to file a report.  Eventually they will have a large-ish file on this dog IF incidents keep getting reported. 
     
    The leg you have to stand on will be in that file.  Repeated reports of abuse, aggression, and/or a dog running at large (even if for a short couple of minutes.) 
     
    If it never gets reported, then there's no file and no leg to stand on.

    Yes, I definitely agree. Call AC and file the report. They have to keep it on file, and even if they don't necessarily have evidence of this occuring (aside from your account), repeated calls voicing your concerns each time this happens to the poor dog will definitely force them to look into the situation further.

There may be power in numbers here if they receive calls from multiple people. Does this happen often enough that you could videotape an occurrence? That would definitely be incriminating...
     
    You have such a good heart throughout all of this, and I commend you for taking such steps to save this poor dog from a life of cruelty.

    There isn't anyone else who has witnessed it that I know of. Like I said, she doesn't hardly ever take her dog outside the apartment. I've only seen him 3 times this year. Once he ran up to us in an aggressive manner. I'm surprised that Max didn't try to fight with him. She slapped him on the butt once or twice then. Another time, I opened my door on a Saturday morning, and the dog was standing right outside unsupervised. The next time I saw him was when I saw her beating him. I honestly don't think that she would do this in front of anybody else. She knows I was the one who filed a complaint with the apartment management against her. So she calls herself controlling her dog from getting to me and Max.

    I'll tell my friends to keep their eyes open concerning this. Thanks for all the advice. Anything else that might be helpful, I'm all ears.

    If you call AC and the dog is removed, would it be euthanised immediately or be held for a short period of time.  If AC has the dog, the rescue could come get it.
