    I just found this. It is our law in Mississippi regarding animal cruelty.

    This statutory section constitutes Mississippi's anti-cruelty and animal fighting provisions. The pertinent anti-cruelty law, § 97-41-1, states that any person who overrides, overdrives, overloads, tortures, torments, unjustifiably injures, deprives of necessary sustenance, food, or drink, cruelly beats, or needlessly mutilates any living creature, is guilty of a misdemeanor. (However, this section was held unconstitutional in Davis v. State, 806 So.2d 1098 (Miss. 2001)). Other sections include mandatory forfeiture of mistreated animals, anti-animal fighting provisions, and separate sections that prohibit the malicious injuring of livestock and dogs.


    So that means that "cruelly" beating an animal was held unconstitutional here? As I said, I don't know much about law, so I am assuming that it is still a crime, correct?

    actually it says the law making it a misdemeanor was held as unconstitutional - in other words not against the law to do it - except it goes on to say the dog can be removed if mis-treated

    Yeah, I saw that about taking the dog away. I was just making sure my eyes weren't deceiving me. So technically in Mississippi right now, there isn't a monetary penalty or threat of jail time if you commit animal cruelty. That's nice. Real nice. [:-]

    I know you despise this woman (we all do) and you are hesitant to talk to her. But what is the worse thing that would happen if you just went over to her place and started up a conversation with her about, I don't know, the pet food recall,,,something. If you have an extra bag of dog treats you could go over there and say "oh i bought these and I already had some at the house" do you think your dog would like these? Maybe if you show her that you are an OK guy and take an interest in her dog, the possibilities are endless. It is never easy to have a civil conversation with someone that you don't care for but this is  about her poor abused dog.
     
    It is difficult to do the right thing but if you don't do it, who will???
     
    Shortly after I married my DH, 4 years ago, his 19 year old son was living with us. He got a dog, without consulting my DH or myself. The puppy peed on the carpet and he proceeded to hit the dog and rub his nose in the carpet. We were not on the best of terms anyway and so I snapped and  told him that was not the proper way to potty train a dog and he will not hit that dog ever again. We got into a huge arguement. He said it was his dog and he could do whatever he wanted to with it. (pride talking as two of his buddies were there) I told him not in this house you won't. I tried to be calm and sensible but I was shaking the whole time (he has a short fuse and I did not know what he was capable of). He never did apologize to me even after his friends told him to. Our relationship is even more strained now but he doesn't live with us and the dog has been re-homed.
     
    I would do it again in a heartbeat...probably with a different delivery next time but I had to be the voice for that little dog.

    it seems like you're screaming at a wall with everything you've tried to do... i almost hate to suggest this, but is there any way you'd be willing to call a local TV news station and report the situation, up to an including the rescue's "not being able to help" and the police and AC policy of non-involvement?  sometimes people's tunes change when the news caravan shows up...
     
    i'm grasping at straws here because you seem to have run out of options.

    Yes, I was hoping that complaining to the management here was going to do the trick. I thought that they would get her to get a reign on her dog. It obviously backfired. She took the easy way out of neglecting the dog and going to the extreme of beating him when he "disobeyed". As for the news caravan, I might be able to get the local campus station to do something, but nobody hardly watches that. I know I never have. The other stations aren't local. I haven't called AC yet. I want to make sure that I have exhausted all my other options before I take that step.

    was stuck between a rock and a hard place. I will absolutely never hit or hurt a woman. Plus she had a dog that is aggressive toward other dogs. He is also an unneutered male dog. Max does not do well with unneutered male dogs. So if I had gone over there, I would have had a fight on my hands. So I did what I had to do to ensure the well being of my dog and myself. And that was getting out of that situation as fast as possible

     
    I hope you don't think I was judging you.  I didn't mean for it to sound that way.  I think you did the right thing, the only thing you could of.  My anger was at her not you.

    Well the Bull Breed Rescue said that they couldn't do anything. I'm beginning to realize that animal abuse is not taken very seriously by the law here in MS. And that sucks..

    Maybe you could get on a rottie forum and ask about a really good rescue group.  They may be in another state, but it's possible that they would pick the dog up.  Or maybe they have fosters in your state that could take the dog. 
     
    I was looking at a dog through a rescue group that was based out of california (I think), but the dog was fostered here in oregon. 
     
    Don't give up.  You are doing a great thing, trying to get that dog out of that abusive situation.  Especially before his behavioral problem escalates.
