    I've had the airbags go off on me before as well. You never expect the "explosion" and all the smoke.

    Well, at least the one side looks good, for the most part.  So glad you weren't seriously injured.  I'm also glad you talked to an attorney.  You can just never be too sure about anything and it's always better to ask than not.

    Yikes!  I'm just seeing this thread --- and my blood pressure is elevated just reading it!  Pregnant or not, your emotional reaction is absolutely appropriate, as far as I'm concerned, Janice.  I would've behaved in the exact same way had it been me.  The scare of a near accident sends my heart rate soaring (and that's just from slamming on the brakes to avoid an accident).  I shake for a long while afterwards -- I can't imagine how terrifying it was to literally be like a pinball, all the while thinking of your baby, never mind your own safety!  Again, my blood pressure just reading this. . . . OMG!

    I'm so glad you're okay and that all signs are that your baby is okay, too.  The photos of your car are upsetting.  I was rear-ended last year, and even though my car isn't brand new, it's not that old, and it's in great shape, and it's only the second car I've ever owned.  Seeing the damage and wondering if your car will ever be the same is terrible.  The adjuster that handled my case was a real jerk -- I had to do a lot of extra phone calling and fighting just to get a rental car for an extra day (a whole $25!!).  I think he was mad that I chose my own body shop (highly recommended by my friend who owns an auto repair shop and has years of history in our town).  This shop wanted an extra day than the adjuster thought necessary.  I detected his nasty behavior as soon as I said I'd be using my own shop rather than their preferred one.  Anyway, based on that experience and that of friends/family who've had accidents, I think it's wise that you gather all the tips and info you can get from knowledgeable folks here and anywhere else you can find them!  As everyone has said, you don't know if there will be issues later with your baby or yourself, and this could be a costly thing in terms of medical bills, time loss at work, loss of a new car, etc.   One good thing is you've know got proof of the excellent safety of the CR-V.  Good to know for when you have a little one in the backseat! 

    What a scary experience, and I don't blame your DH for being ready to punch someone!  And if Rupert weren't such a lovebug, I bet he'd offer to bite him, too!!  Please take care, and I'm so sorry this happened to you!

    In total honesty, I would NOT talk to the insurance company until you contact an attorney.

    No, I know you don't want to sue him for everything. BUT ... you **ARE PREGNANT** and you could develop complications later and you want to make sure it pays for every dime of that hospital stay. 

    Adjusters can be brutal -- and you can wind up signing away benefits you didn't know you had ... call someone reputable (if your family has ANY kind of an attorney -- like for estate planning or business or anything -- call and get a referral).  This guy blew a stop sign that resulted in a 3 car crack up.  YOU hit someone else - that makes things all different.

    Don't be noble -- be smart.  Let an attorney do the negotiating for you.  You don't need the stress, you don't need the down time from work -- this is pretty clear cut and you were hurt enough to have to go to the hospital overnight.  CALL AN ATTORNEY.

    It won't cost you -- you can do something like that on contingency (meaning the attorney gets paid out of the proceeds if there are any, and no charge to you if they don't win - but when some guy blows a stop sign and 3 cards and a preggie lady get damaged there WILL be "proceeds", trust me!!)  You aren't trying to make a million bucks - but you have too much to lose here **because of the baby and braxton-hicks, etc. etc. etc.* -- you won't know that the baby is crystal IN THE CLEAR until after it's born and that will be too late if an adjuster reams you.

    You don't often hear me pull the 'I'm a legal secretary, I know what I'm talking about' card -- but I am here.  My guy is a real estate attorney and I can hear him hook you up with someone GOOD in a heartbeat if you were in Florida.  Just call a reputable attorney and let them refer you.

     

    I would love to read the whole 5 pages but don't really have the time right now.  I'm sorry this has happened and I know how scary it can be.  I wanted to second, third, fourth what Callie said.  I got rear-ended by someone in my 2 week old brand new car and wish I'd waited to settle on the insurance.  My wrist has had problems every since then.  But anyway, they did cover the medical expense for the doctor and then some for pain and suffering.  Not much but you spent a night in the hospital.  Don't let this idiot get away scot free on this.  

    I also say ask for equivalent rental vehicle.  VERY important because it sucks to go from a minivan to a compact car. Sad   And if it's totaled, they will not give you enough money to buy a brand new one.  Trust me on this.  They will give you enough to cover what that car was worth when it got hit.  Not when it came off the lot.  This is where "pain and suffering" comes in.  You'll need that extra in order to get the new car and also probably pay off your car loan!

    I would also wait until the baby is born to settle things.  You can't ask for regular doctor's visits or anything like that but also talk to your doctor about it.  Ask if there are any possible complications, etc that may come up because of it.  Then hold off on the settlement until after delivery if possible.

    Feeling ok today. Back to work. My neck is still pretty stiff on the right side. I'm going to PT tomorrow. The wrist is healing slowly. It's peeling/crusty/scabby. Yum.

    I'm going to reiterate that I bet the insurance company doesn't total the car.  My friend got plowed into on the side and she thought for sure her car was totaled.  Nope, was $1500 from being totaled but the insurance company won't total a car if the repairs are less than the cost of the car AT THAT TIME.  Not new.  Insurance doesn't care that the car is only months old.  And once you drive off the lot, you lose $3000, though with Honda it IS better about that.  So if new, it was $25k I bet they can fix it for $20k or less.

    I'm glad to hear that you're still ok, despite the sore neck.  Definitely see a PT and Chiro.  Look for one that does active release and not just adjustments if you can.

    Oh and about the no pets, what about allowing pets and then getting it detailed inside before returning and then charging that to the settlement.  Big Smile

     Janice, my God! That sounds incredibly scary!! I'm so so glad you are okay and the baby is okay! I think I'd see someone about my neck and spine though, before long. Those kind of injuries can be delayed... Go get a massage, for one thing, that can really help and by golly you deserve it!

     I'd take Callie's advice. I haven't read all the rest of these pages...so maybe you said you are contacting an attorney, but that jerk's insurance company must be peeing their pants in fear you are going to sue him up the wazoo. Which you could. I'm not a litigious person, but I'm older, and as I look back, there are some times when I wish I HAD sued, and should have sued. I think this may be one of those times. (For me it was when I was hired at a factory and ended up training men who then were advanced past me and given 30% more wages, while my wages never increased. Or the time a daycare woman broke my son's elbow by falling on him and DIDN'T take him to the ER!!!)

    Okay, enough of that. The mosxt important thing is that you and your family are taken care of!

    Thanks everyone. I have been going to the chiropractor, and my neck feels much better. My hips and lower back are still sore, especially at night, but that was happening before the accident. I've been going to PT for over 2 months now, and it's still not helping. Sad I think I'm just stuck with it until the baby is born. I'd love to get a massage, but I don't think insurance covers it. I know I could hold on to the receipt and get reimbursed later, but I honestly just can't afford it right now. My insurance payment is due, and I have to come up with $500 for my deductible when I pick my car up. Stupid money.

    The car is getting fixed, and should be done by the end of this week or early next week. I think I might trade it in on a new one, but since I'm broke, I have to wait until I settle the personal injury part so that I have some money to put down (I'm waiting to settle on that until after the baby is born -  just in case). There's about $4,000 difference between my trade-in and a new one. I asked insurance and the lawyer about that, and according to WI law, the other guy is not responsible for the depreciated value because of the accident. No

    Probably a silly question ... but how come you're  responsible to pay the deductible if the accident was someone elses fault?  Unless maybe the "at fault" driver was uninsured?  Seems to me his insurance should be covering everything.

    Because instead of waiting for his insurance to contact me (which they still haven't) and get repairs started, I put in a claim with my insurance. When I get the settlement from his insurance, I'll get reimbursed.
