    I'm so glad you and the baby are ok!  How scary that must have been for you!  I was in an accident over the summer (my first ever and totally not my fault either) and my younger sister was in the passenger side (the side that got hit) and that was scary enough.  I hope you're feeling better soon!

    Wow... won't they call the car "totaled" if the frame is bent? Surely that frame is bent?? Yay for CR-Vs though.. I have an 05, and after hearing your story, I'm really really happy about that!

    I don't know if anyone explained the airbag thing yet, I didn't read every single post, but..they don't actually "explode", as in fire explode, they just come out at HUGE speeds, and basically rug-burn you times a million. The friction generates a lot of heat, which I'm guessing is why your glove melted to your wrist (ouch!).

    It's been a while since I was the parts manager for a bodyshop, but I can tell you that your CRV does not look totaled to me.  It should be able to be fixed, and I would estimate the repair time at 7-10 days.  I don't know which insurance company you have but when you talk to your claims representative, here are some things to stress: 
    • Driver A's insurance should put you up in a rental until such time as your car is repaired.  
    I still have not heard from his insurance. I think they're waiting for the police report. The collision place that my car was towed to gives free loaner cars. I picked up an 07 Honda Accord yesterday. They gave me the choice between that and a Rav4. Since I'm familiar with Honda, I chose the Accord. No pets allowed, though. Sad
    • With regard to your cars repairs, you need to insist upon OEM (Original Equipment Manufacturer) parts.  No aftermarket parts at all.  You need to stress to them that this was a brand new vehicle and you want it returned to brand new status, and the only way to do that is through using ONLY Honda parts.
    • Make sure they use only NEW parts.  No used or "junk yard" parts. 
    The collision place where my car is is an authorized Honda repair shop. They only use new Honda OEM parts, and it does not void the warranty.
    • Make sure that the collision center has a "for the life of the car" warranty on all repairs.  That way if you notice something a week or a month after you pick up your car, you can get it fixed.
    • Insist upon a 4 wheel alignment.  In a front end impact, often times repair facilities will perform a two wheel alignment.  In this case, that's not good enough.
    I'll have to check on the two points above.

    Janice, I'm the LAST person who would suggest a law suit but some of the things that have been said in here are making me think you should contact another lawyer.  Maybe I'm a worry wort but you don't really know the total impact on you OR your baby.  I'm still so worried about you & Jr.

    I am so glad to hear that everything is ok. That you are ok, that the baby is unharmed, and that the care is repairable (??).

     As for the lawyer, you might want to contact another one, or at least, keep very good records for right now in case you need a lawyer later. Last August (06) when I was in a car accident, my mom was driving, and the fault was the other driver (and the person who rear-ended us, but thought she didn't hit us so she left). Originally, the lawyer I am using didn't think it was really a worthwhile case to pursue, so we went with another lawyer. The second lawyer didn't do anything, and I ended up having significant enough medical bills that we went back to the first lawyer.

    Janice... I wanted to post last night but I have dial up and IT SUCKS! Just wanted to say I am glad you and the baby are ok and hope you don't have too much trouble out of the insurance co. I actually work for an insurance agency and can say from listening in to those with claims, some adjusters are buttheads (to be polite lol) Stand your ground and since you are pregnant... I think the lawyer is a great idea just in case something comes up down the road unexpectedly. I hope Roopey Roo is givin u lots of lovins... and I'm so glad DH defended you :)

    I would suggest another attorney also.

    Some idiot blows a stop sign, HITS a pregnant woman, forcing her to loose control and hit another car and that's not worth the attorneys time??  Yes, I understand that he might have been trying to help you come out on top by suggesting you not loose 1/3 of whatever settlement, so find yourself a SHARK who will get the settlement high enough that you don't even notice his 1/3 came out of it.

    I'm old enough that I shake my head at some of the stuff folks file suit about, but, in THIS case, my gosh!!

    As for the car, I do agree with the 4 wheel alignment, and I'm also thinking that looks aren't enough to say that the vehicle isn't totaled.  The front axle could be bent and if it is, I'd flat out insist on a total.  You should be put exactly back to where you were before the idiot blew that stop sign....in a vehicle that is LIKE new.

    yeah, pregnancy hormones suck, but you are suffering emotional distress BECAUSE the idiot blew the stop sign.  That's compensatable.  And the soreness, the possibility of soft tissue damage (ie: whiplash, etc) takes days to manifest sometimes.  You need to see a doc for every little ache and pain...whether you think it's related to the accident or not.  Soft tissue damage is hard to prove, either way, and it can be very hard to treat, so do NOT let these guys off easy.

    You are sooo in my prayers....you and the baby.  Please take care of yourself...and if you are still upset on Monday, stay home.

    Crossover SUVs and most cars these days do not have a frame.  They use a "unibody" construction.  This way of building makes the cars lighter and thus saves on fuel.  Though it doesn't sound safe, they are pretty safe.  In working for over 2 years at a collision center I have seen numerous vehicles that were totaled, some almost ripped in two, but none of them were fatal accidents. 

    In general, unibody construction can be bent during an accident, however, crossmembers can be replaced, straightened and aligned.  The "crash" books have measurements in millimeters to which the bodymen will reference for their repairs.
