    I do agree with Callie.  I've negotiated some large settlements MYSELF, but I'm sure that I would have gotten more with an attorney, and covered my butt more if I'd had a legal mind on my side.  For example, with my husbands accident, I found it very hard to be a hard a$$ with my OWN insurance company!  And honestly, going it on my own took a lot of time, a lot of research and was a major hassle.  And right now, you don't NEED the hassles.

    And, for what it's worth, I think your daughter is just being a bit shy about showing off her parts to strangers!

    Janice, I'm so glad you're okay.  You will be sore for several days, I'm sure, from the impact, seat belt, and stress, so please take care of yourself.  Do you want me to bake some more mint chocolate cookies and send them to you?

    HOW SCARY! Oh my goodness, I'm so glad you guys are okay. Can you get insurance to cover a massage therapist to help you out with the muscle pain? I know a couple of times after a really bad fall from a horse my muscles were so spastic I couldn't even turn my head. After an accident like yours I'm sure you're not feeling so great, not to mention rather stressed out, and maybe a good gentle massage would help.

    Just checking in on ya.  I'm pretty sure you're sore from playing pinball in your car.  On a selfish note, I'm touched that you had the guardian angel with you.  I hope it helped you when you needed it most.  We're all still thinking of you & sending healthy baby & Jano vibes.  As a person who's been in too many accidents lately, the best thing you can do right now is rest.  I'm sure that Roopy would love to be your doggie heating pad.

    I'll leave all the legal advice to those who know better.  I'll just continue to send good vibes your way & send ((hugs)).

    OH, Jan, I am just catching this! (Been away for a few days)  GIANT (but gentle) hugs to you!!  That must have been horrible!!  I can imagine the hysterics anyone would be in with that situation!!  Holy canoli!  Sending special energy to make sure baby and you make it thru the rest of this time as peacefully as possible.  (and good for DH - give him an extra hug from all of us!)  Good luck with the car recovery - but your focus should be on your HEALTH recovering.  Hugs again!

    Thanks everyone. I feel pretty good today, about the same as yesterday. I talked to a lawyer (free consultation), and he actually said that in my case I'm probably better off just going through the insurance companies, rather than hiring a lawyer. Huh? They take 1/3 of the settlement.

    My insurance company has been really good about everything so far. They're sending out an adjuster on Monday or Tuesday. The collision company said it's not that bad and that it's repairable. To me, the car looks completely wrecked. Some of the doors don't open, the front end is on the ground because the passenger side wheel was pretty much ripped off (it was sideways when it was in the snowbank), it just looks tweaked to me.

    Janice, I don't know how I missed this, I'm so sorry!  I'm really glad you and the bump are ok, the soreness can't be fun but hopefully it will go away soon.

    I'm so glad you're still doing well, Jan.  I was hoping you were feeling better, but I guess as long as you aren't getting worse..!

    Oooye!  I would want a total on it, too. It's never quite the same after it's been in an accident.  Looking at the damage, I'm just so relieved it wasn't worse, they hit you square on the drivers side door!  That must have been terrifying.

    Holy buckets - I'm just noticing this thread and the title just made my heart sink!  I'm SO sorry you have gone through this!  And your poor car!  But I am really, really relieved you and baby seem ok.

    I wish I was knowledgeable on the legal aspects.....

    Judging by those pictures, I'd say the insurance company will probably say that the car is totaled.  To replace the airbags alone will cost them a fortune.  Insurance companies don't want to pay out anymore than they have to.  Again, I'm glad to hear that you and the little one are alright.

    First of all.  I am super glad you aren't seriously hurt.  Im also very thankful that the baby is unhut as well. 

     

    It's been a while since I was the parts manager for a bodyshop, but I can tell you that your CRV does not look totaled to me.  It should be able to be fixed, and I would estimate the repair time at 7-10 days.  I don't know which insurance company you have but when you talk to your claims representative, here are some things to stress: 

    • Driver A's insurance should put you up in a rental until such time as your car is repaired.  
    • With regard to your cars repairs, you need to insist upon OEM (Original Equipment Manufacturer) parts.  No aftermarket parts at all.  You need to stress to them that this was a brand new vehicle and you want it returned to brand new status, and the only way to do that is through using ONLY Honda parts.
    • Make sure they use only NEW parts.  No used or "junk yard" parts. 
    • Make sure that the collision center has a "for the life of the car" warranty on all repairs.  That way if you notice something a week or a month after you pick up your car, you can get it fixed.
    • Insist upon a 4 wheel alignment.  In a front end impact, often times repair facilities will perform a two wheel alignment.  In this case, that's not good enough.

    I am really sorry that this happened but I'm glad that you have only bumps and bruises.

    Great points xerxes! Definitely insist on new honda only parts. We once got a side mirror replaced on DH's mustang. We figured it wouldn't make a difference, ford part or generic part. Well the thing didn't even match the other side and adjusting it had to be done manually and not electronically. It looked silly and was a PITA! DEFINITELY insist on parts made for your car.

    I, too, am glad that you are okay.

    And I agree with Ed on everything he said. The accident was initially caused by the first driver with failure to stop at a stop sign and failure to yield right of way to existing traffic. The jeep you banged into should, I think, also be able to claim on the first driver's insurance but they may just claim on yours, even though your loss of control was due to another. And I'm impressed with how well your car held together.
