    NO PAYCHECK

    Hi Guys, Wonder if anyone has an answer for this. 
    I quit my job a couple of weeks ago,,,the owner that I worked for was just the worst possible person to get along with, and very sarcastic and was also very demeaning. I kept going to work thinking that it would get better, half the time on the verge of tears.  After incidents on Thursday AND THEN Friday, and her telling me loudly that she has no confidense in me what so ever...(this is great, I do computerized embroidery for 25 years and she owns this business for 10 and I really can sew circles around her...but she just didn't want me to) come the weekend I was so upset that on Sunday night I just decided I can't go back. I called that night and left a message and said I would send a resignation letter which I did.  I asked in this letter if they would please send me my last paycheck by mail- it was for only 20 hours.  This past Wed. was pay day. Had they sent the check in the mail in wed. mail I would have gotten it yesterday, but I still haven't. I will wait until monday before getting really upset...but DH thinks I'm going to have to fight for it. I DO need the money, but more then that I am really mad.  I am worried if DH is right what I can do about it,,if there is anyone to contact to stand behind me. They know they owe me,,in fact they ose me for an extra hour that I put in two paychecks ago,,,then when it wasn't on there I asked and she said she would put it on the following pay, which she did not.I didn't say anything on THAT check because for one lousy hour I figured it would just make things worse for me,,, but I did tell them about it in the resignation letter,,asking them to please check into it.   I will wait until monday but hoping someone knows if I have a leg to stand on!

    Dyan, I am in Michigan, but I would think Ohio has some sort of Labor Board that you can contact for help if this woman doesn't pay you.  Here, if someone resigns, I think they can demand their final check and we must provide it within a certain amount of time (can't remember - it might be 24 or 48 hours).  If they do not request it, it would go out with the next payroll.
     
    I'm sorry you are going through this.  I read some of the story in another thread and it's a shame this woman can't appreciate what you do because she is so blinded by jealousy.

    Dyan - Sorry to hear you're going thru this.  I've been really lucky to work for good people (and govt - so no paycheck worries) but I can't imagine anything worse than going to work everyday and feeling miserable.  Leaving was a smart decision.  As for the paycheck.  I agree that Ohio should have some type of labor board.  You can usually check online and they'll often have a Q&A section.  I'm betting your question, is a commonly asked one.  If not, you could give them a call.  I hope the check shows up (including the extra hour!) and you can put the whole experience out of your mind and move on to something better.

    Thanks guys.  It IS unbelievable to me,,,what has happened. I worked for 22 years at the same place and left on good terms,,my boss (the owner) was kind of happy that I took off a little weight off of his shoulders because we didn't have enough business for 2 employees,,,and he was being loyal. I went to another place where I was really busy,,,but it closed down. I was very well respected there and many of their customers made it a point to personally thank me for doing a good job on their garments. I do know what I'm doing. But this job I had only 9 weeks and I saw the handwriting on the wall right away,,,the husband was nice and really wanted me there, and convinced me that I've done embroidery way too long to give it up now for some other part time job. BUT they didn't pay me what I asked for, but he said it won't take but a month before I will get my money, that it was just his policy to pay starters the same pay. I believed him and had every confidence in the world that I would soon get my pay, but I wonder now if that is part of the game,,,,keep me from EVER doing a good job to make sure I don't get my pay.   Pay was NOT an issue on why I quit,,,,eventually it might have been. But this lady was such a creep that she wanted to teach me EVERYTHING including everything I knew...and if I ever said "I understand as I used to do that" she would get in my face and say "you need to forget what you knew,,you need to forget where you worked, etc etc!"  It was horrible.She actually told me where to stand and which way to turn to do my job.  I kept doing it the way she wanted me to,,,whether it made sense or not, just because I knew eventually she would like my work and it would all be fine...but as time went on it kept getting worse. I can't believe what a sheltered work life I led...I never had a problem getting along with anyone... so this is all shocking and unbelievable to me. And the final insult if I have to fight for my money......    well, I will wait a few days,,,but mean while try to figure out if there is some kind of labor board.  Thanks guys!

    Okay, that all just sounds really strange and creepy.  I don't know how you hung in for 9 weeks, but good for you for giving it a fighting chance.  Sounds like the woman just wanted to be in control and was very insecure about anyone who knew as much, or even more, than she did.  I actually had a coworker like that once and she was the most condascending person I've ever met.  Fortunately, the other people and the boss really liked me and saw thru her and she ended up quitting.  It helped knowing it wasn't me and that I was doing a good job - and that's how you need to feel about this too.  Don't let this shake your confidence.  You'll find something better and look back with a sigh of relief.  A bad job really makes you appreciate a good one [:)].

    Dyan--On Monday, call her up, saying you're coming to pick up the check and that's it.  She has to pay you but she probably won't mail it just to aggravate you.  Go get your check Monday.

    Thanks everyone,,,,its good to hear your thoughts and ideas. Hopefully it comes in the mail tomorrow,,,it could. But if not, it was suggested by my sons GF who ran a business that I get it a week from payday.    I guess I will call then...or if I get mad, I guess maybe I won't wait that long.....lol!

    I have to agree with Lori - just march in and ask for your check.  I don't see how she can refuse with you standing right in front of her.

    Dyan, I really like Lori's idea.  You are entitled to your final paycheck by law, so she can't refuse to pay you.  I think it's probably true that she's just trying to be difficult.  It makes her feel like she's controlling you if she makes you have to come in or make extra effort to get the check.
     
    I was a payroll manager for several years, and the Bureau of Labor and Industries was a good resource for employees when it came to wage and hour issues.  Each state's laws are different, but for us, we had to have the final paycheck available by the end of the employee's last shift if they resigned with the proper notice period (2 weeks at that company).  If they quit without notice, then we had 3 or 5 business days to prepare the final check (I forget which).  I'm sure you could find the laws/regulations for your area on a state website - just Google "Ohio Department of Labor" or "Ohio Wage and Hour Regulations" or something like that. 
     
    The bottom line is you're entitled to the wages - and if she won't pay you when you ask her, then you'll have recourse by filing a wage claim through the proper state department. 
     
    As the others have said, as crummy as it is to be dealing with all this now, eventually it'll work out for the best.  It sounds like it was a bad environment to work in, so you're making a good change, even though it's hard now.  Good luck!

    I'm agree with Lori too. Go in there and get your paycheck. It's the very least they can do for putting you through hell for 9 weeks.

    I probably did this all wrong at the beginning,,I should have gone there on Monday and just say "I'm sorry, I can't work here but came for my check!" But I'm sure they would have told me that they will pay me on payday or so. They fired Wanda and it was almost a week and a half before payday and they didn't pay her until they paid us..and then I saw an envelope with her name on it sitting there for a couple of days and it made me mad,.because Wanda was a nice lady that was trying her best and did nothing to get fired,,,they told her she wasn't "getting it!"  But I think they hired me to replace her while she was still there and had no intention to keep her. They could have sent her her check right away!  She was a divorced lady with a retarded 21 yr old daughter she had to put in an institution not long before starting there, and I'm sure she really needed the money.  But I know she was very very uncomforable there,,as Phyllis seemed to be treating her really bad,,,and I felt bad for her right away, and after she left, I was her next victim...things went way down hill after Wanda.
    In my letter of resignation, I asked them to send me my check,,at the bottom. As DH said,,they might not have read it to the bottom to begin with. I can see it,,if Phyllis opened the letter she probably didn't even show it to her husband,, because it explained exactly why I left and I apologized to him that I disapointed him but that it could only work if EVERYONE wanted it to work. I gave them a small example of why I couldn't make it work, as Phyllis wanted one way one day, opposite the next and never with a reason that she explained,,,only on a whim and that it was too hard to not be wrong working like that.  I didn't write anything nasty,,,the worst thing was that Phyllis did not want an experienced employee but rather a puppet.   
    But when that Sunday before I quit rolled around, I just got sick to my stomach to think of going back there,,,I knew I wouldn't sleep that night (again) and so I called and left a voice mail before going to bed.  Never even considered going in to quit in person. I was happy to have that horrible experience out of my hair.
    Bureau of Labor and Industries   That is a great place to look if I have to take this further,,,thank you for naming a place to look tacran,,,  Hopefully todays mail brings the check...I'll be sure to let you know if it does!

    Okay,,,just to let you guys know,,,,,,,,,Saturday came and went and no check in the mail today either.   It was suggested I wait one full week from pay day,,,before I worry.    That would be Wed...BUT that  is around 2 and 1/2 weeks from my last day there...seems like a long time.

    I would send her a certified letter 7 days from payday.  Explain that you have not received your check, and that you expect it immedaitely or you will take her to small claims court.  It you don't get it in another 7 days I would go file papers.

    Thats a good idea too Mic! In fact, a friend who works in a major radio station here went to ask her HR guy and he said "call BBB, that they would really NOT get the money they owe you, but would go there and talk to them,,,which would scare a small business who wouldn't want to get their name on their bad list," AND, then go to small claims court, it would only cost $35 but would be worth it."   So thank you for another thought!
    Man,,,what an experience this has been with this one little company!  To begin with, since they deal with a lot of local businesses,,,including a large Country Club that is in the area,,,,I wouldn't think they would NOT do this. I would think they would show some class.  I would think that they wouldn't want anyone bad mouthing their name. I have been in this business for 25 years almost and know many customer and potential customers...THey are so very arrogant, and always knocking others (you should hear them talk about Walmart shoppers) you would think that they themselves wouldn't act like the people they talk about!
