    Dyan what you NEED to do is go online and research what the exact laws are for the state of Ohio.  You should be able to locate all that info on the Ohio State website.  For example, in SOME states if you fire an employee, you MUST give them their final pay check at the time.....if someone quits with notice they get it when they leave, if someone quits without notice within 72 hours.  Some states its the next regular payday either way..... Since it is not uniform from state to state, you need to check what the law is in YOUR state.  Knowledge is power and the more you have the more ammo you have to fight this witch...you'll know exactly what your legal rights are.

    Glenda, that is what I'm trying to do,,to find out what kind of leg I have to stand on. I can't seem to find the info on the Ohio sites but just did find  some on the site for US Department of Labor.     It says:
    Answer: Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment. If the regular payday for the last pay period an employee worked has passed and the employee has not been paid, contact the Department of Labor's [linkWage>http://www.dol.gov/esa/whd/]Wage and Hour Division[/link] or the [linkstate>http://www.dol.gov/esa/contacts/state_of.htm]state labor department[/link]. DOL also has mechanisms in place for the recovery of [linkback>http://www.dol.gov/dol/topic/wages/backpay.htm]back wages[/link].    So I guess Wage and Hour Division is the place to look.   But I can't seem to find what our Ohio laws are.   I will keep looking though.

    BUT what a riot,,,I just put into search "OHIO LAWS ON FINAL PAYCHECKS" and got all kinds of links....gee that was TOO EASY,,,why didn't I think of that before????

    If employee quits: first of the month for wages earned in the first half of prior month; fifteenth of the month for wages earned in second half of prior month. (Ohio Rev. Code Ann. § 4113.15.)
    Shoot,,,,so I have to wait until the first of July before I can say a word it seems.  I actually quit on the 11th of June,,they would have gotten the message on the 12th.

    Well, the law may say that they have so long to give you your check but the law also does not say that you can't go in there every day and demand your check in front of customers. If you go in every day, demanding your check, it may motivate them to give it to you. Bring along some family and let them sing their own refrain of "give her the check." Take along the dog with a saddlebag on with a sign that says "she wants her check." They may give you your check just to make you go away. All of this peacefully, of course. Just wearing them down, like water on stone.

    Dyan, Sorry to here about all this CRAP you have been putting up with. I have been busy but have been keeping you in my thoughts. I would just call and politely tell them you are coming for your check at such and such time and to please have it ready and waiting. If they try to put you off or give you excuses tell them you have already been in contact with the Labor Board and are aware of your rights and would prefer not to have to cause a stink over the money they owe you.

    There are federal laws concerning holding of pay checks.  I am not sure what they are at this time.  I do know there are several things you can do to get the ball rolling.

    First, you might want to make a call to your local office of US DOL - Wage and Hour division.  They are the federal agency in charge of wage disputes.  This question is one of the most asked questions.  The informaiton should be at their finger tips rather than needing research.

    Secondly, if you want to create a really big stink, write a letter to your local congressman and see if someone in his office will look into the problem for you.  Going to the congressman might not work depending on the number of other things the congressman/woman's staff is dealing with at this time.

    Thirdly, depending on how long you wish to wait and how onery you want to be, you might just want to send a certified letter detailing the amount of hours they owe you  for, document what days they are for (ie June 1- 7 hrs - 8AM-4PM less 1 hour for lunch) and tell them you are contacting the US Department of Labor to report them for non payment of wages.

    If this is a  Mom & Pop operation, they might not know this is covered under Federal labor laws.

    I'm pretty sure on stuff like this that the STATE laws over ride the Federal laws.  That was the case when Todd changed jobs and she didn't have to pay him until the regular pay day two weeks later.

    Man, there are a LOT of people getting on my nerves lately.

    I DO have an update,,,the mail came today and still no check. I called afterwards around 4:30 and miss witch with a capital B answered. I politely told her that I knew that Wed. was payday and I waited until today to see if mine would arive by mail and it did not. She said "oh I'm surprised you didn't get it today, I put it in the mail on Friday,,although it was late,,,so if you don't get it by tomorrow, call me!"  DH said "BS,,she probably didn't put it in the mail until you called today!"  I just bet it doesn't come tomorrow!!!!  I just feel she is playing games, but I will see.  IF I have to call her back I will then tell her that I know my rights and know what to do to get it, so if she wants to keep holding on I will take the next step, its up to her if she wants to keep playing the game.  And since I am going thru this,,,I bet she will not pay me for that hour that I worked a few weeks ago that she claimed she forgot to add to my check and would put on next check which she didn't either.

    I got it, I got it!!! The paycheck came in the mail today. AND it DID have the extra hour on it that she owed me...
    Now I can put that horrible experience and those terrible people behind me for the rest of my life!

    Yahoo - Good for you!  I know that must've been a huge relief.  Probably not even so much about the money, but more about the principle of the whole thing.  Whew - that's one life experience you can put behind you and move forward.  Enjoy every penny of it!!
