    California breeder's license details

    Just what does it take to get a breeder's license in California.  I know that there is no statewide standard, but can anyone point to web sites with examples?

    ANIMAL BREEDER#%92S PERMIT
    PURSUANT TO LOS ANGELES MUNICIPAL CODE SECTION 53.15.2, PERSONS ENGAGED IN THE FOLLOWING ACTIVITY ARE REQUIRED TO OBTAIN AN ANIMAL BREEDER#%92S PERMIT:


    "No person shall cause or allow any dog or cat owned, harbored or kept within the City of Los Angeles to breed without first obtaining a breeding permit. Each breeding permit shall be valid for one year from the date of issuance, and may be renewed annually before its expiration date. Each applicant for such permit shall pay an annual fee of $100.00. A separate permit must be obtained for each owned dog or cat which is allowed to breed."

    ANY PERSON ISSUED AN ANIMAL BREEDER#%92S PERMIT SHALL COMPLY WITH THE FOLLOWING REQUIREMENTS:


    1. A. The owner of an unaltered female dog or cat shall not allow the whelping of more than one litter in any household within the permit year. Not withstanding this provision, the General Manager is authorized, upon application of a permittee, to allow on a onetime basis the whelping of up to two dog or cat litters per breeding animal within any domestic household within a year, if the permittee establishes, according to regulations promulgated by the General Manager, that such breeding is required to protect the health of the animal or avert a substantial economic loss to the permittee. In the event that a permittee is forced to euthanize a litter of dogs or cats, the General Manager may authorize the whelping of one additional litter of dogs or cats within the same permit year by the permittee.


    2. B. No offspring may be sold, adopted, bartered, or otherwise transferred, whether for compensation or otherwise, until it has reached the age of at least eight weeks.


    3. C. No offspring may be sold or adopted until immunized against common disease. The sale or adoption of a dog or cat shall include a statement signed by the seller or adopter attesting to the signatory#%92s knowledge of the animal#%92s health and the animal#%92s immunization history.


    4. D. Any holder of a breeding permit who advertises the availability of any dog or cat for sale, adoption, or transfer, whether for compensation or otherwise must prominently display the permit number in any such advertisement. Further, the breeding permit holder must provide the permit number to any person who purchases, adopts, or receives any animal from the permit holder and include the permit number on any receipt of sale.


    5. E. Commercial establishments selling locally bred dogs or cats shall prominently display the breeding permit number(s) of the breeder(s) whose dogs or cats are sold in said establishments and any other pertinent information required by the General Manager. Commercial

    2. F. Any breeding permit holder selling or otherwise transferring a dog or cat, whether for compensation or otherwise, shall submit to the Los Angeles Department of Animal Services the name, address, and telephone number of the animal#%92s new owner within five days from the sale or other transfer, on a Department approved form; and


    3. G. Any breeding permit holder or commercial establishment which sells or otherwise transfers a dog or cat, whether for compensation or otherwise, shall provide to the new animal owner City application(s) for a license and permit as well as written information regarding the license and permit requirements of the City of Los Angeles applicable to such animal.

    And this permit doesn't comply standards with the law if it is passed.  It will have to be modified to comform to the new laws.

    DogAdvocat: Thank your for this posting. It blew me away. Actually it made me a bit crazy now that I've read it a few times. [sm=banghead002.gif]
     
    According to this, there shouldn't be a single litter of cats or dogs in LA without a permit. Best guess from financial info. is that maybe 770 permits were issued. How many litters were there? Are there any penalties? How is this enforced? I saw online that LA has a handful of folks who go door to door checking rabies vacs and licenses--what if they find people breeding without permits? How well publicized is this law?
     
    If there are a large number of un-authorized litters, and the fine was $200 per litter, then you could hire a couple of temps to go through newspaper ads once a week and the fines would MORE than pay their wages.
     
    Best of all, if this law were enforced the number of animals in the shelters would drop and so would the number of animals killed---unless all of these animals are all from out of town (doubt it.)
     
    Bottom line in my eyes: LA is not serious about using this law to eliminate unwanted litters. If they were, they could structure it so that it more than paid for its own enforcement, helped fund low cost s/n, and in a few years the number of litters would drop dramatically.

    If there is any forum member with access to a LA newspaper classified section, does each ad for a litter of puppies have the permit number? 
     
    Aside:  The way I read this, if someone has a breeder's permit and also does rescue, the PetFinder ad for rescues would have to display the permit number - regardless of the fact that the rescue has nothing to do with the breeder's breeding program.  Surely we are capable of writing more precise laws!!

    I did check the on-line classifieds and saw none with a listed permit number.  Of course there is no way of telling if these ads were from inside the city or not.

    I find several things interesting about the LA animal breeder's permit.
    (1)  It only applies to "households", so are commercial breeders banned in LA?   Is there a separate breeder's license that is separate from a litter permit?
    (2)  The same fee is charged if the female is a teacup poodle with one pup or a Lab with 15.
    (3)  There is no provision about returning the money if the female doesn't conceive or the pregnancy yields no live pups.
    (4)  The form asks for the sex of the animal.  Have I missed something?  Is there now another sex other than female that can have a litter?  [;)]

    Is there a separate breeder's license that is separate from a litter permit?

     
    I have been wondering this too.  Let's say a breeder has 4 wifflehounds that are all intact.  (And lets just pretend wifflehounds are an AKC breed.)  #1 is a 7 year old male; #2 is a 5 yo female; #3 is a 3yo female; and #4 is a 1yo female.  #1 is currently being used at stud and the breeder is also planning on breeding #2 this year.  Does the breeder need 2 permits or 4?
     
    Does a breeder's license mean that the breeder doesn't have to get a permit for each animal under ab1634?  Also what is sufficient proof that my 6 month old puppy is in the process of training for a title?

    From the way I read the bill you need a exemption for each dog. 
     
    That is of course your operation has a business license which completely exempts you and you can do whatever you want. 
     
    As far as the city of LA.  It appears that it is on a per dog basis.
