    Louisville ordinance "be afraid, be very afraid"

    Here is information from the Louisville ordinance.  I am seriously thinking about contributing to the defense fund,,, seems like a good use of my entry money for the March cluster.
     

    Here are some of the provisions:
    1) There is no grandfather clause. If you currently own more dogs than are permitted for your lot size (No more than 3 dogs if you have .5 acres or less). If you#%92re over the limit, you are out of luck and out of compliance.
    2) All unaltered (spayed/neutered) dogs must be in an enclosure that has been  *approved in writing* by the Director of Louisville Metro Animal Services.

    3) If you trail ride in the park, you must carry with you a "suitable device for the picking up, collection and proper sanitary disposal" of any manure dropped by your horse. Further, you must actually dismount, collect said manure, and dispose of it while maintaining control of your horse.

    4) Vets are required to turn over their rabies shot records to LMAS
    so that dogs which got a rabies vax but not a license can be impounded.. They are also required to notify their clients of the provisions of this 94+ page ordinance.

    6) If you show your unaltered dog, and travel with it for more than 3 days, you must notify the Director as to the change in location of your unaltered dog.

    7) If you sell, give away, or board (yes, board) your unaltered dog, you must notify the Director.

    8) You may not purchase an unaltered dog without the written permission of the Director.

    9) Revaccination/relicensing requirement for all dogs/cats removed from a kennel or cattery at any time.
    10) Prohibits use of invisible fencing for unaltered dogs.
    11) Mandates spay/neuter for any unaltered dog that is impounded for any
     reason before the owner can reclaim the dog.

    12) If any of your animals (not just dogs)  “irritates” or “perturbs” anyone twice within a 5 year period, you will be forced to give up ALL of your animals and will be prohibited from owning animals again for 2 years.
    13) Prohibits ownership of ANY animals by anyone who has two violations within 5 years-no matter how minor.
    14) Requires reporting of all sales of all dogs, with buyers name & address to   be sent to MAS, even if buyer is not local.
    15) If you have more than one unaltered pet, of any species, then you will need a $300 Animal Dealer#%92s license to sell any offspring of your current pets. This includes gerbils, mice, ferrets as well as dogs and cats.
    16) Every time you pick up your dog, cat, or ferret from a kennel—even a boarding kennel, you must get it relicensed and revaccinated against rabies!

    I live here and I hate that. Alot of this is going to be hard to enforce, the have a hard time enforcing the old laws, let alone the new ones.
     
    I have until Feb to get Kord licensed at the lower rate since he is not fixed yet.
     
    I know they are going over the paperwork still, there are a couple of lawsuits in the works and the Louisville Kennel Club is urging its patrons to boycott the city while attending the dog show that is coming up. The fairgrounds are NOT under the city rule. So they are asking that everyone get places to stay, eat and shop outside the city limits and then send in receipts to the businesses and the city to show what they missed out on.
     
    I do have to say that the MAS director did state that several of the laws were going to be hard to enforce. Guess we see what happens.

    These are some of the most insane things I have ever heard in my entire life. What the h*ll is wrong with these people? It sounds to me like they're just trying to find a way to ban pet ownership. If I lived in Louisville, I would move.
     
    Sigh. This type of thing is one of the many reasons I want to move as far out into the boonies as possible and just hide from the world. I'm so sick of worrying about the idiots in power passing ridiulous laws that affect me and my animals. [:(]

    Wow those laws are extreme, I think the horse manure law is reasonable since they're also one for dogs. The animal dealer law I actually like because that could stop a lot of BYBs but the other ones are just insane!

    Unfortunately if that is 'copied' from how these actually are written they are pretty well unenforceable, which only encourages people TO break the law.
     
    "pets" -- define it?  betta fish?  bird?  So someone is going to come into my house and sex my bird??  WE have never been able to!  He bites! 
     
    ferrets, rats, etc.??  The exotics vets will love it - my rat/mouse/had babies after I bought it!
     
    *sigh*  I keep saying this over and over -- you can't legislate what people should just plain do out of responsibility and courtesy and common sense.  Unfortunately, as Americans, we're always looking for the 'deal' or the 'loophole'.  People begin to want to escape the law simply TO 'escape' it, not because it's wrong or bad.  We've taken civil disobedience to 'lifestyle'.  And the rest of the population sees legislation as the only way to 'quiet enjoyment of their property'.
     
    Define "perturb" - is that more or less than 'bother' -- is that barking for 10 minutes straight or 8? 
     
    And who verifies 'perturb' -- the little old lady who is perturbed from the instant she awakes in the morning? 
     
    or the father of the 3 month old who hasn't had a decent night's sleep in 6 months ('cos his wife was up every hour on the hour the last 3 months of her pregnancy) who calls to 'report' the 'barking dog'.  He doesn't stop to realize that the 'barking' he heard out his bedroom window is NOT the dog on the other block behind him where the fenced dog was asleep until he rattled it's fence (that one actually happened TO ME several years ago).
     
    The lawyers in town who do code enforcement law have had a heyday (and trust me -- THEY have helped draft this nonsense -- I've worked for attorneys who have drafted crap like that *sigh*) AND the only ones who will profit by this are the attorneys who try to defend or prosecute this stuff.  It's full of glittering generalities - words that evoke emotion but you can't pin them down.
     
    and honestly?  You can't move out to the boonies to 'escape' -- then you're 3 hours from the nearest GOOD vet and the city will find you eventually.  The suburbs are full of people who "moved out of town" 15 years ago only to find themselves in 'suburbia' now.

    Fish, insects and eggs are 'safe'.  That means you don't have to 'alter' your pet tarantula or Hermit crab ... opps, nix the hermit crab, he/she'd have to be altered.  So those kids who have to take 'care of an egg' for a high school project are safe as well.  So's your betta fish.  phew.

    exempted are breeders who fall under Dept. of Ag. jurisdiction. So, a byb would not necessarily have to leave town if they are license by USDA.

    I didn't get to finish my earlier post b/c my kids are driving me crazy, but I wanted to ask, who and/or what is behind this law? Sweeping, absurd legislation of this type is usually a knee-jerk response to something. Was there a highly publicized dog attack, raid on a puppy mill or something? Also, who put forth the legislation in the first place, do they have a personal ax to grind? Knowing KY politics, somebody with money wants this in place, and that's why such a ridiculously broad policy was put forth.

    pit bull deaths in 11/05 if I have the date correct. t here is also room of PETA money behind the counsel woman who proposed it, since KFC is headquartered in Louisville.  Problem is this will have no impact on the folks who were irresponsible to begin with.  Not to mention the cost and manpower necessary to implement.  Originally the law was breed specific (all bullies) but that language was revised.

    Which someone has to pick up. With the shovel, muck bucket, and giant disposal bag we all carry when we ride. I can't believe that one got through - Kentucky is one of the horse ownership capitols of the world.

    Well, I guess if they actually start enforcing this and Louisville becomes the Petless City, maybe they will think twice.
