It depends on the state .. I can tell you that the young man in my story did not get off. It's just all such a waste of life ... and because I knew him as a very young 10 year old boy, and I know both parents 'abused' him (I saw his mother break a plastic lunchpail over his head into smithereens IN FRONT OF ME HIS TEACHER for not telling her to sign his homework -- as she sat in her car with an open can of beer in the drink older on the door of the car, her breath reeking so I smelled it 3 feet away -- just one of MANY things I witnessed).
My heart breaks for all -- because it's not just about "who killed this little girl" -- but it's the waste of life in the lives of the mother and father who were so dysfunctional that they grew up thinking this was "discipline" AND that you have to stay with someone who is this wrong. To be so utterly without any kind of sound judgment ... it's so sad that she's pregnant again.
If this father raged like this that one time, you can bet your last dollar it wasn't the first time. "rage" like that comes from incredibly wrong thinking and a lifetime pattern of unbelievable violence. Usually "violence" that was the norm in how they were reared. And I'll bet you it was on BOTH sides. Either Mom was violent too (she's doing a lot of "poor me" to be innocent) or Mom was completely without judgment as to how unsafe this man was to be around. Animals are usually far far better parents than human ones like this. *sigh*
