    [&:] an 80 year old woman, apparently evil knows no age. so we are buying this caravan from this old lady right, we owe her 2 payments, one by the end of this month and one by the end of january and its paid off. so, she just called here and after blah-blah-blahing she tells me she is mad because i make her call me long distance and it's running up her bill. which i didnt make her call, but its an old lady, so ok, i can listen to you whine while you run it up more, no problem.
     
    so i assumed she was calling to see how the van was running. but instead she called to tell me she wants her payment within 7 days or she is going to take us to court, further she says, if you don't pay me and we go to court, i have the only reciept and it will probably just dissapear and i will tell the judge that you hadn't paid anyhting on it. wait what did you just say lady?! i could not believe it, i was like lady that is lying and extortion, what is wrong with you?! she then goes on to ask me what the problem is, just pay her the money. which i do have every intention of doing, by the time it is due on our contract, she had no reason to even be calling in regards to the money, and she called to threaten to take me to court and further lie, wow, and everyone thinks its the kids these days.
     
    so anyway, im a bit perplexed right now. and for some reason grandma got ran over by a reindeer is playing in my head!

    God knows what's going on in her head right now, could be her meds, start of dementia of alzheimers, just be patient w/ her, we will all be there one day if we are lucky.

    The elderly don't always get stuff right and then they meditate on it and get it even WRONG-ER.
     
    Many years ago when I bought my house, I bought it from an 85 year old woman.  She was upset at the closing because SHE THOUGHT I was supposed to pay "first and last month" just like if I was renting from her ... and of course you pay your closing costs and then you don't owe your first 'payment' til next month.
     
    So for TEN LONG YEARS this woman thought I was 'behind on my payments' and she called, threatened and hassled me every single month for TEN very long long years.  I was never so glad in my life as the day I paid her off that idiot balloon payment and got her out of my life.
     
    She can cause you hassle, and she'd probably win just because she IS a "defenseless little old lady'  -- it may honestly be worth your while to try to borrow money from family and pay her off early.  and then decide never EVER to buy something from someone outright ever again that way.

    Wow.  What an ordeal, and a week before Christmas yet.  I'm going to assume that if there's a contract, you also have a copy of it and either receipts from her or cancelled checks. If so, and if she takes you to court, she won't have a leg to stand on. It's just that it creates a major hassle for everyone involved.

    That was my thinking. When I was paying on my house, I kept every posted check copy for every payment and logged it in the amortization table. That way, if necessary, I could have the bank print off that check number and that it had been posted and cashed or deposited. And I never had problems with the lady. But she did die the week I sent in my last payment. So, I had to hire an attorney to work with her completely helpful and compliant son to get my clear title. I had found out about it soon after because I had included a note with the last payment for a title release, as per our contract agreement, which had been signed in the presence of lawyers, etc.
     
    In any case, I hope there is proof of payments made on this vehicle.

    we have nothing, but the title, which she signed over to us. stupid stupid stupid, i know and we both should have known better. i just didnt think this old woman would try to shaft us in any way. i guess i was extremely wrong.

    we DO have the signed title, but in this case, if it went to court it would look like this nice old lady signed over the title to her vehicle, and that we are trying to take advantage of her by not paying, since it was already signed over.

    she tried to tell me i have to send her a money order by mail because " she cannot be there at our beck and call" (her exact words). yeah, she is not getting anything without us being there in person and getting the reciept right that minute.

    we have one of those silly digital recorders, if she calls again i'm going to record it.

    Actually your Money Order is your receipt and you can send it to her via registered mail,or a tracer on it to see she got the check. Because you fill out the MO in order for her to cash it in.

     i wouldnt sign a title over or even give it over until i have full payment..

     If you were in NY...you could say you paid her cash and the title was your reciept...

     i wouldnt personally do this,i would be glad to have her out of my hair..

      registered mail would require her to have to sign for it,and a tracer sent out on the money order would tell if it was cashed...

     I personally would bring cash,with a witness,and if she refused to give you a reciept marked paid in full for the car with the vehicle ID number on it,i would walk away and tell her to see me in court..as i stated before,once the title is signed,the vehicle is yours...someone may have told her this and now she maybe freaking out about it..thats why the rush for the money..

      NEVER EVER put a deposit on a car without the following on the reciept.

      Vehicle ID number

      Agreed apon price

      Amount of deposit

     Date of transaction

      Sellers signature

     And finally,check the current and valid title for liens against the vehicle.

    good advice mhaddog. i guess i am not very trusting of people. i always try to make sure i have some kind of paper trail when buying something like that.

    OK... you have the signed title from this little old lady.  I know you said that's all you have (was hoping to see something about a bill of sale stipulating the payment schedule).  Has the title already been registered in your name? (and is she listed as a lienholder by chance?) On the title, is there a place for the amount paid for the vehicle?  I know titles are different in other states (some need signatures to be notarized, some don't).  I was thinking, maybe if there's a place for the amount of money agreed upon, you could have her sign a statement with the next payment you give her - stating the amount paid and how many payments remaining.
     
    I also think maybe you should borrow money and get her paid off but when you do that... get a receipt from her showing paid in full.  And if possible, have it done in front of a notary.  I know here in WV, if you have something notarized (whether it's on regular paper or toilet paper lol) it's a done deal.  I hope you can get this taken care of without her threatening again.

    after dh got home and i told him about the obscene phone call he told me not to worry about it, she is senile. ok great, why are we buying stuff from her then?!
     
    he has known her for a long time, she's his uncle's neighbor, so it's not just some random people on the side of the road. the title is already registered to our name (insurance requires it). dh doesn't think she will do anything, says she was just having a "moment". i'm really not all too concerned about her taking us to court, i was just in extreme shock at her demeanor. i have learned my lesson on trust though, even the elderly are no longer on my safe-list, which i find sad.
     
    on another funny note, this old lady is a lesbian. no offense to lesbians, i love them just as much as i love anyone, but it is really weird to think of a little eighty year old lady as being one. [sm=biggrin.gif]

    After spending Saturday with a wonderful senior who suddenly became argumentative and totally set in her position, my first thot would be that this poor woman has some medical issues that are affecting her thinking and actions.  If you know the family perhaps a call to them is in order.  These ",moments" can indicate a serious problem and if the family is aware of them they can do something to help before it is too late.
