    Here's what happens when people have connections

    This is long, but has a point
     
    Since the mold inspection was done, The rental tribunal gave me the steps to take next.
    1) contact the Property Standards Inspector
    2) contact the health board
    3) File a maintanence complaint and an Interferance of living form
     
    The property standard came out and was shocked at the problem. His words were "Holy $h!t"  He than said he would give the landlord 3 days to get the water out and have a company here to fix the damages. He also said he was not a mold specialist but the environment was perfect for mold.
     
    I waited a week to hear back from him, he complely changed his attitude. He said the landlord was going to tear the house down so the problem was solved. I asked him if he served the landlord with a Notice of Violation form. (which I was told by the health board and the tribunal that he HAD to do)  He said no because the lanlord did what he asked him to do.  (the landlord did not do what he asked. ie: pump water, fix problem.)  The guy said he stioll would not serve papers. So I called the Mayor. I told the Mayor the story and first thing this morning I get a call from P inspector and he says "I will be there today to serve the landlord papers, and I will bring you a copy"  Why the sudden change of heart?  Because I called the Mayor.
     
    I then called the health unit. This woman I talked to said she did not need to come out and see the problem because she knows nothing about mold. I said that's fine but you can see that the water is a major health concern, so could you please come and look at that? She says "No" 
     
    Soooo, I called our Member of Parlament and told them that she refused to come out. 3 hours later I get a call back from the women. She asks me what I want from her and I repeat what I had asked of her earlier. She says " You didn't ask me to come out there earlier." (LIAR)  So she comes out today. She shows up in high heel boots and a black long fur coat. She is being a total biatch to me. She says "I don't see a problem other than the water needs to come out." She said that water muct have just gotten there. I said No, it's been there for 3 years. She says "Than why did you stay here?" I explained that I could not afford to go anywhere else and that we didn't notice a problem until we started to get sick.
     
    So she got pissy with me saying I should have never called The MP's office. I said "well it got you here, didn't it."  I told her I need papers stating why I had to leave this house and that there is a health risk, this way it protects us as tenants and if we ahve health problems later.  She asked if i smoke and I said yes, she said welll that can show why you have health problems. I said sure but my kids don't smoke, so why are they sick? She then shut up.
     
    I talked to the lanlord last night we gave him notice that we out out of here this Saturday. All the cared about was were we going to pay the rest of the rent.
     
    I called the mold inspector today and he said the reason I am not getting the proper things done here is because my lanlord works for the town. He has for the past 35 years. The Property standards works with him. The health lady works with the property standards guy. This is not even about sticking it to my landlord. My big problem here is that no one cares that my children and are are sick because of this house. Everyone is trying to cover each others @$$. So it's all on who you know.
     
    So what did I get after all this? I pay my rent, move, pay for storage, seperate my pets, and move in with my mother, and then drive my kids 30 minutes to school everyday. There is not enough protection for tenants. This lanlord, and th health board should not be able to get away from this. There is not even a slap on the hand. My landlord still could rent this house after I leave, because the people he works with did not push the issue. And even if he does knock  the house down he still gets money from the lot.

    Personally I'd call the media in. Nearest BIG city media and hand it off to them...they would be only too happy to expose a corrupt small town gov't. It's what they do best aside from vilifiying pb's these days!

    I would call the landlord and tell him you have no intention of paying the rent.  See what he says.

    I did call the newspaper and  the news, they said they will get back to me. Our town is now under investigation because of a voting problem on Tuesday night, so the news should be thrilled to get the story on a town covering this up.
     
    We did tell the landlord that we would not pay what we owe, and he didn't say much, but I don't trust him. He says he does not want to get lawyers involved or go to court, but I can't trust him.
     
    At this point I just want to walk away and get the hell away from it all, but my DH is p'd big time and wants to fight because we are not being looked after like we should be. I took a video of the problem and I took pictures and I have been documenting everything, so if the landlord did decide to fight us for the money, I do have something to back us up. The only downfall would be that if we lost we would have to pay him. If we win, who knows what could happen. I just don't want to fight. If I had more sympathy from the town and the health board maybe, but things are just to fishy with the people involved. Who knows what they'll come up with.  It really disgust me.

    Call his bluff.  Tell him you have documentation from officials and video evidence showing that the house is uninhabitable.  Tell him to bring in all the lawyers he wants and that you are looking forward to it.
     
    Having been a landlord, I know it is impractical to sue for past due rent.  There is something to be said for evicting someone, but not for suing after the fact.  Don't give him another dime and move.  You will never hear anything from him again.  Of course, this may not be good advice in Canada.

    I'm so sorry to hear about all your problems with your landlord!  People like this make me so mad!  [:@]  If the city won't do anything about it and the media is dragging their feet is there someone higher up you can go to?  Might as well keep climbing the ladder until you get some results, especially when it comes to you & your family's health!

    Billy,  DH and I agree with everything you said. I mean is it worth it for him to try and get $1000, when he takes the chance of being sued himself?
     
     Dh says there is no way he will pay and says 'let the landlord come after me, i don't care. This SOB will pay"
     
    The impresion I am really getting from people is that they think it's just another whining tenant. but this is our health here.  I called the Rental tribunal and pretended to be the landlord in this case and the guys advice was ' Go ahead and file for your money if you want to, but I strongly recommend you get a lawyer as well, because if I was your tenant I would sue you"
