    But a spay/neuter contract is at the buyer's expense correct? In my experience most rescues have the spay/neuter done at their expense.

    Mine doesn't.  The full adoption price includes a spueter most of the time.  But, in the case of the large breed litter I had, it's a return at around 8 months of age for the spueter.  They normally DO charge a spay/nueter deposit, but I was able to waive it for the pups that I adopted to idoggers.

    Crock, It does sound like a sticky mess. My suggestion is to get a letter from the vet stating the spay issue in which his/her recommendations and status of the bitch.
    Secondly, gather all the information, receipts, expenses for the care of the pups and place them into one file. If you feel it necessary to retain an attorney, do so. Also make a copy of the contract in which you adopted the pregnant mom.
     
    I have never heard of a rescue allowing a pregnant dog to be adopted out before she's had those pups.
