    Prayers and good thoughts please

    I really don't like to ask for things for myself but I could really use some strong i-dog prayers right about now.
    In 2003 I fell at work and totally screwed up my foot and ankle, had it on video and everything. To make a long story short, I have yet to receive any compenation from workers comp because they refuse almost every claim made. My final hearing is on Monday the 27th and if I lose this one, that will be the end of it. They have made earlier decisions that my foot problem is age related, not work related even though it was witnessed. grrrrrrrrrr
    My witness was killed in a car accident in late summer of 2003 so they seem to feel powerful because I walk into the hearings alone. They say that from the video, my fall doesn't seem so bad, even though I knock down a heavy metal cupboard.
    I am asking for your powerful prayers because I can no longer go on like this. My foot is totally killing me, I walk with a perminent limp and my back is being affected to the point that I live off of pain meds and anti-inflamitories which in turn has caused stomach bleeding and I have to take Nexium for. If I loose this hearing, I will not receive any treatment or orthodics and will end up being less and less capable of getting around.
    I just want to return to my old self and get back to work.

    I was injured on the job....a torn rotator cuff that led to a blown disk while rehabbing the shoulder after surgery.  WC refused to pay for the neck just because they could and when I appealed it took a couple years to get things straight.  I did eventually prevail, but it took  a TON of fighting.  Do you have a WC attorney?  Sometimes you need one to represent you and get the things that you deserve.  I didn't use one, but I'm stubborn and hard headed and refused to be beaten by a big insurance company.  I don't know how WC works in Canada.....it's a bit different in each state HERE, but by golly, I'm sending you every good thot I can muster and a TON of prayers.

    Lena, do you have an attorney???  If you can't afford one because you've been disabled by this accident, maybe legal services in your area can find one for you pro bono.
    I can tell you that most settlements aren't huge anyway.  My BF got one once when a truck dumped a load of steel on the trailer he was in - he went flying out of the trailer onto his back on the ground.  They gave him money, but it wasn't nearly enough to compensate him for a permanent injury that still bothers him 10+ years later.

    In this country at least, a WC settlement should include future medical.  In my case anything related to EITHER shoulder, the neck (and once there is fusion in the neck the liklihood of other damage increases) and even the hip where they harvested bone were factored in to my settlement.  Future medical should be the bulk of any offer and it has to be reasonable and based on what the PAST medical has been, factoring in inflation, etc.  Pain and suffering is normally not huge, and the BEST way to go is not to take a lump sum settlement, but leave the case open with whatever small stipend they allow monthly and the medical left in their pockets.  Now I know in Canada, medical isn't quite the finance drainer that it is in the States, but factoring in what has to come out of pocket for the docs that aren't covered by whatever the medical plan is, for pain meds, etc, thats HUGE.

    Here in Canada we have representation by the "Office of the Workers Adviser". Funny thing about this is that they are also part of our government, so it's government fighting government. Blahhhhhhhh
    I know that it is going to be quite the fight as I now have more problems due to my original injury. My back is so messed up and there is some curvature of the spine.
    The person representing me said they are going to freak because I haven't been looking for work. The only job I have ever done is retail management which requires being on your feet all day. I have been taking a course online for basic business but had to put it on hold as I was starting to rob Peter to pay Paul and couldn't afford the $120.00 each month.
    I don't know what's going to happen but the worst case senerio is that I can legitimately pan handle(only kidding)[;)]
    I will just be glad when it is over, to much pressure for me. The closer the hearing gets the less sleep I seem to be able to get. I'll probably look like a bag by Monday.

    I have also been thinking of you the past few days. I love our tele-chats, you always make me feel good. You can make the gloomiest day shine brightly.
    Today hasn't been very good to me, I'm full of worry.
    I keep telling myself that everything happens for a reason so I have to wait and see what the outcome is and then try to figure things out.

    Lena I just sent you a huge email -- I wasn't able to call tonight but I will tomorrow.  But that doesn't mean my prayers weren't strong for you.  Honestly?  my prayer for you is that you will see tomorrow that you won't go alone.  But rather, you will go with a whole host of angels, as well as God.  My prayers will be with you all day long.  And hopefully I WILL be able to call tomorrow evening.  But if you print out what I sent, at least I can be with you in spirit!! *hugs*

    Lena, sending plenty of good thoughts and vibes and crossed fingers your way.  Having worked in the payroll and Human Resources area for a number of years, I remember how rough a lot of worker's comp settlements can be.  The insurance companies seem to look for every chance they can to avoid paying out benefits.  I hope you have positive results!
