    I can't believe she is actually suing for this...ROFL! So ridiculous. Maybe I should sue for everytime I have felt discomfort from my bra.  =)

    GREENVILLE, S.C. -- A woman has filed a lawsuit claiming that she was injured by a bra. The suit names Victoria's Secret as the defendant.
    Jessica Lang, of Greenville, said she bought the bra at the Haywood Mall store in January 2005. The suit claims that early one morning while wearing the bra, she felt discomfort in her breast. She says when she removed the bra to alleviate the discomfort it "malfunctioned," leaving a 3-inch long, ¼-inch deep laceration on her left breast.
    Lang's suit claims that she was treated for the injury at Doctor's Care Berea, and missed several days of work following the incident. She says she was fired because of missing work.

    Lang's suit claims the bra was "negligently and carelessly manufactured," and was "unsafe for its intended use."
    She also claims that the injury will affect her pursuit of a career as a model. She is suing for lost wages, pain and suffering, future disability, loss of prospective business relations and medical expenses.
    Victoria's Secret answer to the lawsuit denies all Lang's allegations and says the claims demand "strict proof."
    The company's response says that the injuries, "which are denied," were caused by Lang's "carelessness and recklessness."
    They also cited the lawsuit claim for punitive damages as inappropriate and in violation of the constitution.
    The company's response said "any injuries and damages sustained by the plaintiff may have been as the misuse and/or abuse of the product in question."
    The Hughey Law Firm of Mount Pleasant, SC is representing Lang in the suit against Victoria's Secret.

    People are insane!  Personally, I think they should make it so both the individual and the lawyer that bring these stupid infantile cases into the court system be required to pay all of the court costs, laywer fees etc. of those they are suing and the tax payers if the suit is deemed frivilous and stupid.  I bet that would cut down the number of these stupid cases!

    The woman lives in a town about 30 miles from me, so this was on the news last night.  Apparently the woman wants a jury trial but the court suggested the two parties work it out on their own first.  How much you wanna bet she tries to get a modeling gig for VS out of the deal?!

     Sounds to me like she doesn't know how to take her clothing off.

     
    On a similar note I had an "old" bra that was really poking me one day. When I took it off the underwire had broken and popped through the material. It did leave a irritation mark on me. Damn I through the bra away I could have sued! Right? Wink

     What's really funny to me about this is that I actually work for Victoria's Secret, and this is the first I've heard of it! Stick out tongue

    And to be honest, I can't figure out how the bra cut her.  The bras just aren't...made that way.  If the bra was 2-3 years OLD, perhaps the wire finally broke, but it shouldn't have popped through the fabric.  We hardly ever have returns because of broken wires.  Plus, I'd like to know how it cut her when she was taking it off to "relieve the discomfort".  Wouldn't it have cut her while she was wearing it?  Not removing it? Tongue Tied

    Crazy!  I hope it all works out.

    Yes!!  A "loser pays" system.  I'm all for it.  I'm sitting here trying to figure out how the heck she did this to herself.  Even if the wire did break and poke through the fabric, how in the world would it leave a cut that was a quarter inch deep???  I've had (non-VS) bras break wire and poke through the fabric, and all that happened was a little red irritation spot.  She wanted a jury trial?  Oh, Lord.

    I would be so pissed off if I were to get called for jury duty to hear nonsense like this.

    I've had the wire come threw the fabric, but never cut me! I can't even imagine how it could cut that bad even if you were trying to cut yourself with it. Thats always been with cheapo bras that it has happened with too. My VS bras tend to last a long time. Normally they last a few years and then the hooks wear out, but not the wire.

    OK - call me naive.  How does a bra malfunction, other than maybe having a strap break?  That would be a nuisance, but how would it cause an injury? Even underwires aren't sharp enough to injure anyone if they happen to pop through. Methinks someone is bored and looking for a lawsuit to entertain them.

    You've got it.  Especially since about half of the VS pushup bras now have liquid gel pushup.  Could you imagine if the bras had sharp wires, and a wire popped into the padding?  That would be quite a sight. Big Smile
